Biography

Kevin was born into a military family on a military installation. After graduating from high school, Kevin worked in a steel mill as a steel worker, and attended Southwest Texas State University, now known as Texas State University, graduating in 1984. Kevin entered law school at St. Mary’s University Law School, San Antonio, in 1985 and graduated in 1988. During law school he worked as a law clerk in a large litigation firm.

Kevin has been licensed to practice law since 1988. He is licensed in or practiced before many courts including The United States Court of Appeals for the Armed Forces sitting in Washington D.C., The United States Court of Appeals for the Fifth Circuit sitting in New Orleans, LA., The United States District Courts for the Western, Northern Eastern, and Southern Districts of Texas, The United States District Court for the District of New Mexico sitting in Albuquerque, New Mexico, The United States District Court for the Southern District of Mississippi sitting in Jackson, MS, United States District Court for OSHA Appeals sitting in Baton Rouge, LA. Kevin has handled appeals before the Texas Supreme Court and most every Court of Appeals in Texas.

Kevin is a member of the San Antonio Bar Association and the Permian Basin Trial Lawyers Association.

Kevin is a trial lawyer. He has successfully tried personal injury cases of many types recovering millions of dollars for his clients since 1988. His first two million-dollar cases were before 1990. He has continued that pattern of success for his clients his entire career. Some of the types of cases he has tried include product liability cases, motor vehicle crash cases, assault liability cases, premises liability cases and work injury cases all involving serious injuries or death to the clients and/or their family members. The work-related injuries include oil field accident injuries in West, South and East Texas and include injuries that occurred on construction sites and in manufacturing.

Kevin has tried hundreds of workers’ compensation matters both at the administrative level and in District Court. One notable case involved a DPS officer who had a stroke on the job rendering him permanently paralyzed on the right side of his body. His claim was denied by the State of Texas which led to a workers’ compensation claim, a trial, and an appeal of the jury verdict in favor of the DPS officer. That client was awarded lifetime medical benefits and weekly payments, and he is still receiving them.

Another notable workers’ compensation verdict was for a truck driver involved in a rollover of his rig. His claim was denied. The workers’ compensation carrier alleged that he was drinking on the job. After a favorable jury verdict, the client is still receiving lifetime weekly payments and medical benefits since he is wheelchair bound as a result of the rollover accident.

He regularly represents clients in what are known as third party cases. These are cases where an injury has occurred in the work place and those injuries were caused by a person or company that is not a co-employee of the injured person. In those cases, he represents the client in the workers’ compensation case and then also in the claim against the company that caused the injuries. Much of his practice today is third party practice. A representative case includes an oil field worker that was killed in a truck accident while driving for work. Kevin handled the workers’ compensation claim for the disputed issues recovering death benefits for the widow. After succeeding in the workers’ compensation claim, Kevin sued the party responsible for the death of his client recovering $5 million for the widow and the children left behind.

In another similar case, Kevin handled the workers’ compensation claim for a widow of a man killed as a result of a defective truck in the oil field. He filed suit against the manufacturer of the truck that caused the death recovering over 3 million dollars for the widow and his children. In another oil field related case Kevin recovered over 5 million for the family of a worker killed while driving between locations in the oil field.

Kevin has successfully defended companies that were insured where the insurance carriers have refused to deal with the company in good faith arising from serious work related injures or death. In those cases, he has sued the insurance carrier for the company for failing to properly handle the claims against the employer. Kevin has handled a large number of insurance related contract and bad faith suits against insurance carriers that have failed or refused to properly treat the insured in good faith.

Kevin has successfully tried oil field theft cases brought by the FBI Oil Field Task Force against companies and employees for Federal Criminal Violations involving Federal Wire Fraud, and Mail Fraud in the oil field in Federal Court.

Kevin has defended U.S. Army Rangers in General Courts Marshal and handled those cases on appeal for those service members.

Kevin has successfully defended employees and companies when a workers’ compensation carrier has brought criminal insurance fraud charges against those employees and companies alleging that they had committed insurance fraud. In those cases, following successful dismissal of the criminal charges, civil cases have been successfully brought against the workers’ compensation carrier that brought the criminal charges against the employee or the company.

Kevin has successfully tried commercial litigation cases involving disputes between stockholders or disputes between two or more corporate entities.

The most difficult issues to deal with as a personal injury lawyer are those when a family member leaves home in the morning and does not return. Dealing with the fall out of that tragedy with the spouse and the kids left behind are emotional issues tools for which are not taught in law school. Kevin deals with these issues regularly in his practice. This part of the practice of law makes the lawyer an attorney and a counselor at law, which Kevin is.

Kevin is married with three successful adult children, and a Weimaraner “gun dog”. Kevin enjoys hunting, working outside, weightlifting, and shooting at the gun range in his spare time.
