Who pays after an uninsured driver causes a Texas crash?

The Law Offices of Miller & Bicklein, P.C. |

Texas requires that all drivers obtain a license before they drive any vehicle. Drivers who want to operate their own vehicles also need to register their vehicles with the state. To register a vehicle, a driver first has to provide proof of liability insurance coverage.

A driver pays for insurance in case they cause a crash that damage is someone else’s property or injury another person. Unfortunately, sometimes, drivers in Texas get into crashes caused by someone without an insurance policy. What happens after a crash with an uninsured driver?

Texas has a low rate of uninsured drivers

Your chances of a crash with a driver without insurance are lower in Texas than in most other states. In 2019, roughly 8.3% of Texas drivers didn’t have insurance. If you do get into a crash with a driver who doesn’t have insurance, you may be able to return to your own insurance policy for coverage.

If you have uninsured driver protection, your policy will cover the losses that you could have claimed against the other driver’s coverage. What if you don’t have special coverage?

You can take the other driver to court

If you don’t have uninsured driver coverage, you still have another option for seeking reimbursement for your losses. You can bring a personal injury claim against the driver who caused the crash. A successful claim could result in a judgment that helps you cover repairs to your vehicle, lost wages and medical bills incurred because of the wreck.

Irresponsible drivers who don’t carry the right insurance put everyone else at risk on the road. Knowing the law can help you seek justice when someone else’s irresponsible decisions affect your finances after a major car crash.
